Is There a Law About a Mis-Quote?


Is there some kind of a law that when an automobile insurance agent gives a car insurance quote and then goes up, they have to honor the initial quote?

Leonard,
Thanks for the question.  Normally, when you get car insurance quote from an automobile insurance agent they rely on statements that you make when providing the quote.  If you apply for coverage and the company learns that your application has incorrect information (such as an undisclosed accident or ticket or additional drivers in your household) they will update your application/policy and update your premium with the new information.  They will then send you a notice with the reasons for the update/uprate and include a bill requesting that you pay the difference.  Some Georgia insurance company’s will even cancel the policy if your undisclosed activity makes you an un-acceptable risk according to their standards.

Now, this next part is very important; in Georgia the insurance company only has 60 days from the effective date of the policy to take this action.  This period of time is known as the “discovery period”.  If a company learns of these undisclosed violations on the 61st day or beyond they do not have the option to update your policy mid-term.  They can only update your policy at the next renewal.

If you do not agree with the decision of the company canceling your policy you have the right to appeal. Just look at the back of the notice for details on this appeal process.  By Georgia law every notice of adverse action or cancelation or non-renewal must list the ways to appeal a company’s decision.

Back to the question at hand; there is no law that requires an agent or company to honor a mis-quote.  And here is the kicker; they don’t have to honor a mis-quote even if it’s a company error.  But if you believe that the automobile insurance agent did something illegal regarding your car insurance quote you can always make a complaint with the office of the State of Georgia Insurance Commissioner John Oxendine.
